FTC Delays Enforcement of Red Flags Rule to June 1, 2010
The Federal Trade Commission has announced an additional extension of the enforcement date for the Identity Theft “Red Flags Rule” to June 1, 2010. Although the rule actually became effective on January 1, 2008, enforcement of the rule had been set to begin November 1, 2009.
This is the fourth extension of the enforcement date of the Red Flags Rule since October, 2008. The current extension is at the request of several members of Congress, due to legislation which is currently being debated to exempt certain entities from the rule (e.g., health care, accounting and legal practices with 20 or fewer employees and certain other businesses). The FTC is being asked to delay enforcement until this legislation is finalized and it is known which types of entities will be exempted.
Please note, as with the earlier extensions, this delayed enforcement date does not apply to the rule regarding address discrepancies applicable to users of consumer reports.
